An Ashburn, Virginia-based technology company was fined by the Department of Justice after advertising in job listings that it was seeking “white” candidates.
A Loudoun County, Virginia-based technology company has been fined by the Department of Justice after advertising in job ads that it was seeking “white” candidates.
A job ad for Ashburn-based Arthur Grand Technologies posted in March 2023 said the company was only looking for “born-born U.S. citizens.” [white] Anyone living within 60 miles of Dallas, Texas [Don’t share with candidates]” according to a Department of Justice news release.
The Civil Rights Division's Immigrant and Employee Rights Section began its investigation in May 2023 and “determined that Arthur Grand discriminated on the basis of citizenship status and national origin after a recruiter working for Arthur Grand's Indian subsidiary posted a job ad on the job site Indeed.”
Following this posting, the ad was widely circulated online. An investigation by the Office of Federal Contract Compliance Programs found that the company had advertised the Dallas business analyst position through a public online job site.
“It is shameful that, in the 21st century, employers continue to use 'whites only' or 'born in the U.S.' job ads to exclude otherwise qualified job applicants of color,” Assistant Attorney General Kristen Clarke of the Justice Department's Civil Rights Division said in a statement. “I share the public's outrage at Arthur Grand's egregiously discriminatory actions to exclude job applicants based on citizenship status, national origin, color, and race.”
As part of the settlement with the Department of Justice, Arthur Grand will pay a civil penalty, educate employees about the requirements of the INA, revise its employment policies, and be subject to Department of Justice oversight.
Arthur Grand will also have to pay compensation to people who filed complaints with the Office of Federal Contract Compliance Programs.
